International phase of the PCT
This phase starts with filing the PCT application at the Receiving Office, which can be the OEPM (Spanish Patent and Trademark Office), the EPO (European Patent Office), the WIPO (World Intellectual Property Organization) or the specific bodies of other countries. This lasts 30 months from the filing or priority date.

In this phase, the application files, the languages used, the background reports and the application publications of more than 148 countries are unified.

After this phase, you will decide which countries you want to continue with the patent file, and then you will go onto the national phase.

National phase of the PCT
In this phase, you can choose the following ways to continue with the protection process:

National patent: In the countries where you want to continue.

European patent: In the 38 member countries of the European Patent Treaty.

Other ways: Other international agreements of the countries of your interest.

Once you have decided in which countries or regions you want to confirm your PCT protection process, A2 Estudio Legal will advise you at all times about which method will best meet your needs and how to approach the examination process, and we will register your patent.

If you want to protect your patent, our team of experts are at your disposal, including official agents, which enable us to represent you at the Industrial Property Offices, and lawyers, which help us to act in the event of licensing or usurpation of rights with maximum guarantee.
