Why should I register my trade mark in China before entering the market?
China uses a "first-to-file" system: the first to register owns the trade mark, regardless of who used it first. There are documented cases of third parties registering well-known European trade marks in China before their original owners, blocking their market entry. Preventive registration at CNIPA is the most effective measure.
How long does trade mark registration in China take?
The standard process takes between 12 and 18 months if there are no oppositions. Accelerated registration is possible for certain classes. Given the risk of trade mark squatting, we recommend starting CNIPA registration at the same time as EUIPO registration, without waiting until the company actively decides to enter the Chinese market.
Do contracts with Chinese partners need to be in Chinese?
For a contract to be enforceable before Chinese courts, it is strongly recommended that it be drafted in Chinese (Mandarin). In the event of a discrepancy between the English and Chinese versions, Chinese courts will apply the Chinese version. We work with specialist legal translators to guarantee exact equivalence between both versions.
What is PIPL and how does it affect European companies operating in China?
The Personal Information Protection Law (PIPL) is China's personal data protection law, in force since November 2021. European companies that collect data from Chinese citizens or export data from China to the EU must comply with PIPL. This includes obtaining explicit consent, appointing a local data protection officer and obtaining regulatory approval for certain types of data exports.
